So, what’s the tea? (What’s going on?)

A small group of powerful lawmakers struck a last-minute deal during the government shutdown to put temporary limits on hemp-derived intoxicating products. It wasn’t a full ban, and it wouldn’t have passed under normal debate; it was attached to a must-pass bill to reopen the government.

But it tells us something important:
Congress does want regulation — smart, adult-use rules that keep low-dose beverages available while cracking down on the bad actors.

For years, parts of the hemp industry ignored a growing problem. Some companies turned legal hemp into high-potency synthetics, packaged them to look like candy, and sold them in places where kids could access them. That behavior drew national attention, so Congress finally took action.

This isn't about safety. It's about consolidating industry at the expense of small businesses and limiting consumer choice.

What’s at stake? (Why this matters)

If the rules don't change in a year, here’s what it means for you:

As a founding member of the Coalition for Adult Beverages (CABA), we are one of the leading voices advocating for responsible regulation of hemp-derived THC beverages! We believe hemp-derived THC beverages should be treated like other adult-use products like alcohol and include regulations like:

Clear National Standards

We want federal regulation that creates consistency across states, including:

  • Stringent testing and labeling requirements
  • Age gating and responsible marketing practices
  • Packaging guidelines to protect consumers and minors
  • Licensing and enforcement structures that prioritize safety

Guardrails, Not Prohibition

Prohibition drives consumers underground and penalizes responsible operators who are trying to protect consumers and businesses with:

  • Potency limits for hemp-derived THC beverages
  • Licensing pathways for compliant manufacturers and retailers
  • Preemption protections that respect state leadership, but prevent arbitrary crackdowns

Cann is ready to lead the always-compliant, low-dose beverage side of the industry. But regulators also need to hear from real consumers. If lawmakers only hear about the most dangerous products on the market, we risk losing access to the safe ones.
